\ud83c\uddee\ud83c\uddf9\u00a0All\u2019indomani dell\u2019invasione da parte della Russia, l\u2019Ucraina ha\u00a0avviato una causa contro la Russia davanti alla Corte Internazionale di Giustizia, sostenendo di essere stata falsamente accusata di aver commesso un genocidio, in violazione della Convenzione sul genocidio del 1948, ratificata da entrambi gli stati. In risposta, la CIG ha ordinato (invano) alla Russia di sospendere le operazioni.\u00a0Il procedimento \u00e8 attualmente in corso e l\u2019Ucraina sostiene, tra le altre cose, che l’aggressione della Russia\u00a0\u00e8 illegittima e che dovrebbe portare ad un risarcimento danni.<\/p>\n

Non si tratta dell\u2019unico caso avviato\u00a0dall\u2019Ucraina contro la Russia, ve ne sono altri che sono\u00a0attualmente pendenti in varie sedi,\u00a0che sono attualmente al vaglio\u00a0degli organismi internazionali competenti.\u00a0Scrive il Financial Times: \u00abThe ICJ case is just one way in which Ukraine is attempting to harness the rule of law, by bringing legal cases in the criminal and civil courts\u00bb.\u00a0Lo stato di diritto \u00e8, secondo Kelly, ci\u00f2 che distingue le democrazie dalle dittature, eppure \u00e8 stato anche definito come \u201cestremamente sfuggente\u201d. Ci\u00f2 richiede che al fine di tutelarlo vi sia una comunanza di vedute, e come\u00a0scrisse una volta il compianto\u00a0giudice Trindade (CIG):\u00abl\u2019attuazione della giustizia richiede unit\u00e0\u00bb, non solo fra diversi tribunali ma tra diverse regioni del mondo, perch\u00e9 solo in questo modo \u00e8 possibile assicurare la tutela dei diritti umani, e in quanto tale, aggiungiamo, dello stato di diritto.<\/p>\n

\ud83c\uddec\ud83c\udde7\u00a0In the aftermath of the invasion by Russia, Ukraine filed a case against Russia with the International Court of Justice, claiming that it had been falsely accused of committing genocide, in violation of the 1948 Genocide Convention, ratified by both states. In response, the ICJ ordered (in vain) Russia to suspend operations. The case is currently underway, with Ukraine claiming, among other things, that Russia’s aggression is unlawful and should result in damages.<\/p>\n

This is not the only case initiated by Ukraine against Russia, there are others that are currently pending in various fora, which are currently being considered by the relevant international bodies. Writes the Financial Times, “The ICJ case is just one way in which Ukraine is attempting to harness the rule of law, by bringing legal cases into the criminal and civil courts.” The rule of law is, according to Kelly, what distinguishes democracies from dictatorships, yet it has also been described as “extremely elusive.” This requires that in order to protect it there must be commonality, and as the late Justice Trindade (ICJ) once wrote: “the implementation of justice requires unity,” not only between different courts but between different regions of the world, because only in this way can the protection of human rights, and as such, we would add, of the rule of law, be ensured.<\/p>\n
