Across the East Countries, Hong Kong is going to review its Copyright legislation in order to keep track of the latest developments in the field of Artificial Intelligence (AI).<\/em><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" style=\"margin-top:var(--wp--preset--spacing--30);margin-bottom:var(--wp--preset--spacing--30)\" \/>\n\n\n\n<p>The <strong>rapid increase<\/strong> of <strong>Artificial Intelligence<\/strong> (AI) has been attempting current global legislation dealing with Intellectual Property and Copyright.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full is-resized has-custom-border is-style-default\"><img loading=\"lazy\" decoding=\"async\" width=\"1414\" height=\"2000\" src=\"https:\/\/sites.unica.it\/holmes\/files\/2024\/05\/AI_Freepik.jpg\" alt=\"\" class=\"wp-image-385\" style=\"border-radius:100px;aspect-ratio:1.7777777777777777;object-fit:cover;width:664px;height:auto\" srcset=\"https:\/\/sites.unica.it\/holmes\/files\/2024\/05\/AI_Freepik.jpg 1414w, https:\/\/sites.unica.it\/holmes\/files\/2024\/05\/AI_Freepik-212x300.jpg 212w, https:\/\/sites.unica.it\/holmes\/files\/2024\/05\/AI_Freepik-724x1024.jpg 724w, https:\/\/sites.unica.it\/holmes\/files\/2024\/05\/AI_Freepik-768x1086.jpg 768w, https:\/\/sites.unica.it\/holmes\/files\/2024\/05\/AI_Freepik-1086x1536.jpg 1086w\" sizes=\"auto, (max-width: 1414px) 100vw, 1414px\" \/><figcaption class=\"wp-element-caption\">Credits: Freepik<\/figcaption><\/figure>\n\n\n\n<p style=\"margin-top:var(--wp--preset--spacing--30);margin-bottom:var(--wp--preset--spacing--30)\">Thus, several States have been dedicating a&nbsp;<strong>specific legislation on AI<\/strong>, especially to regulate&nbsp;<strong>Generative AI<\/strong>.<\/p>\n\n\n\n<p>In the last years, the legislatory wave has been increasing dramatically in the&nbsp;<strong>West Countries<\/strong>.<\/p>\n\n\n\n<p><em>In this regard<\/em>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>European Union<\/strong> has been just completing the <strong>legislation process<\/strong>, to approve a <strong>Regulation<\/strong> towards AI (the so called \u201c<em>AI Act<\/em>\u201d), which will be binding for all European Member States;<\/li>\n\n\n\n<li>In the <strong>US<\/strong>, several laws have been passing in the last semester. Recently, on May 13, <strong>Colorado passed the Senate Bill <a href=\"https:\/\/legiscan.com\/CO\/bill\/SB205\/2024\">SB205<\/a><\/strong>, entitled \u201c<em>Consumer Protections for Artificial Intelligence<\/em>\u201d, as a new AI-specific law aimed at preventing biased and discriminatory decision-making in critical areas (such as employment, education, finance, government services, healthcare, housing, insurance, and legal services).<\/li>\n\n\n\n<li>Moreover, <strong>Brazil<\/strong> had introduced in the Congress almost <strong>three different AI laws<\/strong>, between 2019 and 2021.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" style=\"margin-top:var(--wp--preset--spacing--40);margin-bottom:var(--wp--preset--spacing--40)\" \/>\n\n\n\n<h4 class=\"wp-block-heading has-text-align-center\">Across the East Countries, <strong>Hong Kong<\/strong> is going to review its Copyright legislation, which came into force in 1997.<\/h4>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" style=\"margin-top:var(--wp--preset--spacing--40);margin-bottom:var(--wp--preset--spacing--40)\" \/>\n\n\n\n<p>Pursuant to the <strong>Hong Kong Government<\/strong>, the amendments of the <strong><a href=\"https:\/\/www.elegislation.gov.hk\/hk\/cap528\">Copyright Ordinance<\/a> aim to keep the line with the latest developments in artificial intelligence<\/strong> (AI), as well as to <strong>ensure<\/strong> that <strong>Hong Kong&#8217;s copyright regime remains robust<\/strong> and competitive.<\/p>\n\n\n\n<p><strong>Pursuant to the current version of the Cap. 528 Copyright Ordinance, <\/strong><strong>9 categories<\/strong> of copyrighted works can be protected as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>literary works<\/li>\n\n\n\n<li>dramatic works<\/li>\n\n\n\n<li>musical works<\/li>\n\n\n\n<li>artistic works<\/li>\n\n\n\n<li>sound recordings<\/li>\n\n\n\n<li>films<\/li>\n\n\n\n<li>broadcasts<\/li>\n\n\n\n<li>cable programmes<\/li>\n\n\n\n<li>typographical arrangement of published editions<\/li>\n<\/ul>\n\n\n\n<p>Furthermore, the Ordinance considers the <strong><em>author <\/em><\/strong>&nbsp;(\u4f5c\u8005), in relation to a work, as <strong>the person<\/strong> who creates it.<\/p>\n\n\n\n<p>In this regard, experts in the field have claimed changes to legislation, in order to protect creators who use <strong>Generative AI<\/strong>.<\/p>\n\n\n\n<p>The Director of the Government\u2019s Intellectual Property Department, David Wong Fuk-loi, mapped out a consultation plan with online service providers.<\/p>\n\n\n\n<p>Topics involve broader issues dealing with the interplay between AI and Copyright which are not covered by existing laws, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Copyright of AI-generated content;<\/li>\n\n\n\n<li>Machine-learning answers and models;<\/li>\n\n\n\n<li>The protection of AI content creators.<\/li>\n<\/ul>\n\n\n\n<p>The <strong>legislative refreshing can be set out in the field of public policies<\/strong> on smart cities and digital government.<\/p>\n\n\n\n<p>Actually, Government has been actively applying artificial intelligence (AI) technology to promote the development of smart city and digital government.<\/p>\n\n\n\n<p>Therefore, <strong>the Office of the Government Chief Information Officer<\/strong> (OGCIO) <strong>formulated<\/strong> the <strong><a href=\"https:\/\/www.ogcio.gov.hk\/en\/our_work\/infrastructure\/methodology\/ethical_ai_framework\/\">Ethical AI Framework<\/a>, as a Guideline for<\/strong> <strong>government bureaux and departments (B\/Ds)<\/strong> on implementing projects that involve the use of AI technology.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" style=\"margin-top:var(--wp--preset--spacing--30);margin-bottom:var(--wp--preset--spacing--30)\" \/>\n\n\n\n<p class=\"is-style-info\" style=\"line-height:1.4\">Di <strong>Alessia Palladino<\/strong><br><em>Assegnista di ricerca e Cultore della Materia in \u00abInformatica giuridica\u00bb e \u00abComputer Law\u00bb\u00a0 presso l\u2019Universit\u00e0 degli Studi di Cagliari.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The rapid increase of Artificial Intelligence (AI) has been attempting current\u00a0global\u00a0legislation dealing with Intellectual Property and Copyright.
